Skyfire Applied Intelligence Private Limited ("SkyFire", "Atom360", "We", "Us", "Our") provides an oral cancer screening mobile application by the name of berry.care that enables people to click images of the parts of the oral cavity and have a doctor remotely review it and provide feedback ("Service"). Skyfire is committed to protecting your privacy and this Privacy Policy applies to everyone who uses the Service. At Skyfire, protecting the privacy Customers, Users and Visitors is a core business principle. We understand that the information you provided belongs to you, not to Skyfire.

This Privacy Policy deals with the method and purpose of Skyfire's collection of information before, during, and after your use of the Service. This Privacy Policy also applies if someone else uses the Service on your behalf. If any word/phrase has been defined within the Terms and Conditions but has not been defined within this Privacy Policy, that word/phrase will have the meaning that has been assigned to it in the Terms and Conditions. This Privacy Policy is subject to Skyfire's Terms of Service, as updated from time to time.

1. What type of Information does Skyfire collect?

Skyfire collects personal information about (1) Customers & Users; and (2) Visitors. Collectively, the personal information about Users and Visitors is referred to as "Personal Information". If an individual uses Services directly on its own behalf, then such individual is both a Customer and a User. Skyfire may collect the following information from you:

a) Information collected from Customers & Users:

For Registration

  2. Email address
  3. Mobile number
  4. Date of birth or Age
  5. Gender
  6. Password
  7. Approximate location
For every screening
  1. Information about habits such as smoking, consumption of chewable tobacco or alcohol and the duration for which these habits have existed
  2. Ability to open mouth Trismus Test, any symptoms of pain and any details to be specified to the doctor
  3. Images of the various parts of the oral cavity which may include but are not limited to left, right, upper and under tongue, left and right cheek, uvala, upper and lower teeth
  4. A record of feedback from each Doctor after screening an individual
  5. A copy of the final report generated for the User
For Payment
  1. Credit card/debit card numbers
  2. Payment wallets
  3. Netbanking among other forms of payment related information

In order to improve diagnosis, the Customer or User may opt for multiple screenings.

Data is collected by a person on behalf of Customer or a User during a screening ("volunteer") is shared with hospitals conducting the screening in the form of a consolidated report at the end of the day. While this report may be accessible to doctors affiliated with the hospitals, we never share your name, email address, mobile number, date of birth, gender, or password with any doctor or hospital for any reason Screenings may be conducted through your personal account or through the account of an Organization. If your screening is done through an Organization's account, all data regarding the screening, including but not limited to personal information and feedback received from any volunteer, is shared with that Organization. Organizations require access to this data in order to provide advice or treatment.

Skyfire gathers and analyzes product usage analytics, including integration metrics and API/SDK usage data, solely to improve the Service. This data pertains to your interactions with berry.care's app or other apps where our solution is integrated. It includes information such as clicks/taps within the app, sections accessed, and app usage frequency. We do not collect any unrelated data from other apps or services. This data is neither used nor shared with any third party for any purpose other than improving the Service.

2. How does Skyfire process Personal Information?

We may use the Personal Information collected within the Service for the following purposes:

a) Performance of Service

To provide the Services in the normal course of Our business, We undertake the following activities:

T o provide the Services in the normal course of Our business, We undertake the following activities: (i) onboarding Customers or Users; (ii) enable individuals to seek consultancy for oral cancer; (iii) enable third-party organizations to seek consultancy on behalf of individuals for oral cancer; (iv) allow communication between a remote doctor and the individual or an Organization acting on behalf of an individual; (v) formulate a report for an individual based on the doctor’s feedback; (vi) communicate with a doctor, an individual, or an Organization in cases of emergency; (vii) administer and safeguard Your account; (viii) contact You regarding technical support; (ix) send You information that You have requested about a product or service; (x) respond to customer service requests; (xi) address and discuss billing issues; (xii) create personalized services for the Customer; (xiii) facilitate Your communications with other users when You use the Service; (xiv) improve the performance of the Service; and (xv) bring to Your attention any aspect of Our mutual business, including but not limited to changes to agreements or this Privacy Policy.

b) Payment

We may use the payment-related information collected from within the Service for the following purposes: (i) Receive payments from individuals for consultation; (ii) Make payments to Doctors for screening and feedback; and (iii) Processing invoices for Customers.

c) Legitimate Interest

To protect Our legal rights, to improve the performance, features and security of the Services by analysing user behaviour, or for detection or prevention of fraud or misuse of Our Services or properties.

d) Vital Interests

If and as necessary to protect Your vital interests or the vital interests of another natural person, such as if required to provide medical aid.

e) Compliance with a Legal Obligation

To comply with Our legal obligations and for law enforcement purposes, for compliance with a legal requirement or court order.

3. Who do Skyfire share Personal Information with?

Skyfire does not use or disclose Personal Information for purposes that are materially different from those described in this Privacy Policy. We do not sell Personal Information to any third party. Except as provided in this Policy, your information will never be sold, traded, rented or shared with any other legal entity for any purpose except (a) transfer to third-party service providers who help us facilitate our business activities, and (b) compulsory legal disclosures (if any).

4. What rights do You have under this Privacy Policy?

We at Skyfire respect your Right to Privacy and the right to access your personal information. We collect information from individuals, doctors and Organizations acting on behalf of individuals. When information is submitted by an Organization, we have no direct relationship with the individuals with whom the Organization may interact using the Service.

If you wish to access, correct or delete unreliable data and are unable to do so using your account the Service or if you do not have an account on the Service, you may contact us with your request. Please allow reasonable time for us to review your matter. We may request additional information or require verification of your identity before taking any action on your request.

You may exercise the following rights for Your Personal Information:

a) Data Ownership

You own all personally identifiable information that You bring to Our Service. We may process the Personal Information in accordance with this Privacy Policy.

b) Right to Erasure

Skyfire deletes Personal Information subject to Section 5 below. In certain situations, We may retain some or all of Your Personal Information in accordance with Section 5 below. We may refuse to grant this request if We consider the retention of Personal Information to be necessary for Us to protect Our legal rights, for law enforcement purposes, for compliance with a legal requirement or court order, or for the detection or prevention of fraud or misuse of Our Service or properties.

c) Right to Access and Correction

Upon Your request, We will inform You whether We hold any of Your Personal Information, and if yes, what Personal Information We have. Some categories of Your Personal Information can be modified in Your account. For Personal Information that cannot be modified through Your account, please contact Us. Unmodified Personal Information may remain in back-ups and records subject to Section 5 below.

d) Right to Nominate

You may designate an alternate individual who, in the event of Your demise or incapacitation, may duly exercise the rights conferred in this Privacy Policy.

5. Data transfer, storage and retention.

By accessing or using the Services, You agree and provide Your consent to transfer and store Personal Information, including personally identifiable information and sensitive personal data, to Our servers located in India.

Personal Information submitted by You for the purpose of seeking information about Our services and products will be retained for a period of up to five (5) year, and will thereafter be deleted or anonymized unless You subscribe to a service or purchase a product or service. Personal Information of customers that have purchased a product or service or subscribed to a service will not be deleted automatically. If You request the deletion of Your Personal Information under Section 4.b) above, We will delete Your Personal Information, except that Skyfire may retain Personal Information as described below:

Legitimate Interest: Personal Information necessary for Our legitimate purposes, such as record keeping, resolution of disputes, enforcement of Our agreements, protection of Our rights, prevention and detection of fraud, or misuse of Our Services or properties, may be retained as long as necessary for such legitimate interests. We will not retain data for such legitimate purposes if We believe that Your interests or fundamental rights and freedoms override Our legitimate interests.
  2. Legal Obligation: Personal Information necessary to fulfil Our legal obligations, such as taxation, data retention, reporting obligations, and other obligations under Applicable Law, court order, or law enforcement request, may be retained as long as required to comply with such legal obligations.
  3. Anonymized Data for Service Improvement: We may retain de-identified or anonymized data for improving Services, and for researching and creating of new Services.
  4. Service Research and Development. We may use data collected through our services, including anonymized, aggregated, and other relevant data, for research and development purposes. This helps us enhance the functionality of our services, train advanced AI models, and innovate new features and products. All data usage for these purposes is conducted in compliance with applicable data protection laws and with a commitment to maintaining the security and confidentiality of your information

8. How does Skyfire protect Personal Information?

Skyfire undertakes commercially reasonable measures to protect Personal Information. To prevent unwanted and unauthorized access to Personal Information, Skyfire uses the following methods, techniques, and technologies:

10. Communications from the Service

We may use your email address to send updates and alerts with respect to the Service. If you do not wish to receive such communication, you can opt out by sending an email to support@atom360.io. Additionally, we may publish your comments / reviews / testimonials on our Service. Such comments / reviews / testimonials may certain contain personal information. Please contact us if you feel that a comment / review / testimonial has been published with your personal information without your consent.

11. Changes to This Privacy Policy

We reserve the right to update this Privacy Policy at Our discretion. Any significant changes will be communicated to You via the Services or email. Continued use of the Services after changes constitutes Your acceptance of the revised Privacy Policy.

12. Do not track.

Our website currently does not respond to Do Not Track requests from web browsers or other software.

13. Legal Disclosures

We withhold the right to impart with your personal data as required by applicable law, in reply to legal requests by public authorities, including meeting national security or law enforcement requirements and when we believe that disclosure is necessary to protect our rights and/or to comply with a judicial proceeding, court order, or other legal process served on us. Your personal data may also be shared between our group Companies for the activities permitted under this Policy.
